BizMilesDed Terms of Use

1. Acceptance and eligibility

By downloading, accessing, using, or purchasing a subscription to the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use or purchase the Service. You must be at least 18 years old and legally able to enter into this agreement.

2. What the Service does

BizMilesDed helps you record routes, classify business and personal trips, manage vehicles and drivers, estimate mileage deductions, and export reports. Features may depend on location, motion, notification, background-processing, printing, sharing, and app-store services supplied by your device.

The Service is a recordkeeping tool only. It does not provide tax, accounting, financial, or legal advice and does not guarantee that any trip or expense qualifies for a deduction.

3. Your records and responsibilities

• You are responsible for reviewing the accuracy and completeness of every trip.
• You must correct GPS errors, classifications, dates, mileage, rates, and vehicle details.
• You must keep any supporting documentation required by tax authorities or other parties.
• Trips are saved to your account once they end. You are responsible for exporting the reports you need to keep. Trips still waiting on your phone to sync may be lost if you delete the app or lose your device before they sync.
• You must use the Service safely and must not operate your phone while driving in violation of law.

4. Paid subscriptions, cancellations and refunds

Available plans, billing periods, and prices are displayed before purchase. Prices may vary by country and may include taxes. In the apps, purchases are processed by the Apple App Store or Google Play and managed through RevenueCat. On bizmilesded.com, purchases are processed by Stripe. MKME does not collect your full payment-card details.

• The Individual / Self-Employed plan includes one driver (you) and one vehicle.
• The Business / Corporation plan includes up to three people (you and two drivers) and up to three vehicles.
• Subscriptions renew automatically for the same billing period until canceled. Cancel an App Store or Google Play subscription in that store’s subscription settings before renewal, subject to the store’s deadline and terms. Cancel a website subscription in Settings on bizmilesded.com, under Manage billing.
• You must cancel at least 7 days before your subscription’s next renewal date. This deadline follows your billing cycle, not the first day of a calendar month.
• An App Store or Google Play account is charged when you confirm the purchase, and the store may charge renewal fees shortly before the current period ends. A website subscription is charged by Stripe at the start of each billing period.
• Deleting the app does not cancel a subscription. Deleting your account cancels a website subscription at once; an App Store or Google Play subscription must still be canceled in that store.
• Once your card or store account has been charged, we do not issue refunds for that payment, including renewal charges or unused portions of a billing period.
• This policy does not override refunds or cancellation rights required by applicable law or the Apple App Store or Google Play’s rules. Store purchases are subject to the applicable store’s cancellation deadlines and refund procedures.
• For website billing questions or a refund required by law, contact support@bizmilesded.com. For App Store or Google Play purchases, use the store’s refund request process.

We may change future subscription prices or plan features. Any price change will be handled with the notice and consent required by the applicable store and law.

5. Acceptable use

You may not:

• Use the Service unlawfully, fraudulently, or to create false records.
• Interfere with, disable, overload, or attempt unauthorized access to the Service.
• Reverse engineer or bypass access, subscription, or security controls except where law permits.
• Copy, resell, sublicense, or commercially exploit the Service without written permission.
• Use automated systems to scrape or extract the Service’s content or functionality.

6. Ownership

You retain ownership of information and records you enter into the Service. MKME and its licensors own the Service, software, design, branding, and related intellectual property. We grant you a limited, personal, nonexclusive, nontransferable, revocable license to use the Service under these Terms.

7. Third-party services

The Service depends on third-party services such as the Apple App Store, Google Play, RevenueCat, Stripe, Clerk, Google Maps Platform and other mapping services, Android and iOS location services, and device sharing tools. Their separate terms and privacy policies apply. We are not responsible for third-party outages, denials, billing decisions, location inaccuracies, or changes.

8. Availability and changes

We may update, suspend, limit, or discontinue features to maintain security, reliability, compliance, or business operations. We do not guarantee uninterrupted availability, perfect GPS accuracy, recovery of trips that never synced, compatibility with every device, or that tax rates and laws shown in the Service remain current.

9. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” MKME disclaims implied warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, and uninterrupted operation. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, MKME will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost tax benefits; fines; penalties; business interruption; or lost or inaccurate data arising from the Service.

MKME’s total liability arising from the Service will not exceed the greater of the amount you paid MKME for the Service during the 12 months before the event giving rise to the claim or US $100. These limits do not apply where prohibited by law.

11. Suspension and termination

You may stop using the Service at any time, and you can delete your account in Settings. You remain responsible for canceling any active App Store or Google Play subscription. We may suspend or terminate access if you materially violate these Terms, misuse the Service, or create security or legal risk. Sections intended by their nature to survive termination will remain effective.

12. Governing law and disputes

These Terms are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in a court of competent jurisdiction in Texas, unless applicable consumer law requires otherwise.

13. Changes to these Terms

We may update these Terms as the Service or law changes. The revised Terms will display a new date. We will provide additional notice for material changes where required. Continued use after revised Terms take effect means you accept them, except where separate consent is required.
